What are Cohabitation Agreements?

A cohabitation agreement is an agreement executed as a deed which records arrangements between two or more people who have made the decision to live together. This can be as a couple or otherwise.

Cohabitation agreements are commonly entered into by people who have decided to live together but are not married and want to record their financial and living arrangements both during cohabitation and if cohabitation comes to an end. They can also be used by people who have decided to pool their financial resources and purchase a property to live together.

The agreement will record each person’s rights and responsibilities in relation to the property where they intend to live, the financial arrangements between those people both during and following cohabitation. It will also record the arrangements to be made in the event they decide they no longer wish to live together.

A cohabitation can also be used to record ownership of personal property that may have been used by both/all persons during cohabitation but are to be retained by the owner when cohabitation ends, for example, vehicles or items of furniture.

A cohabitation agreement can be executed before the parties begin living together or after cohabitation has begun.

Are Cohabitation Agreements legally binding in the UK?

It is important that you seek independent legal advice when looking to enter into a cohabitation agreement and it is drafted in accordance with contractual principles to reduce the scope for argument about the validity and enforceability of the agreement.
