What is a consent order?
A consent order is a legal document that is issued in family courts to make an agreement between parties legally binding. A consent order can be used for a variety of purposes including dividing assets such as property, pensions, savings, investments and debts between the parties within a divorce.
How often does a judge reject consent orders?
If the parties have taken the appropriate legal advice and the consent order has been prepared correctly with any reasoning provided in relation to any unequal division of assets between the parties, subject to the consent order being reasonable and fair in all the circumstances and in line with the law, consent orders generally are rarely rejected.
How long does a consent order take?
In straightforward cases, a consent order can be granted in 3 to 5 weeks. However, often it can be longer and a consent order can only be considered and lodged with the court once a conditional order for divorce has been granted.
What happens after a consent order is approved by a judge?
Once a consent order is submitted to a judge online and a judge has considered the terms of the consent order, if the judge approves the terms of the consent order this is sealed by the court and is legally binding once approved by the judge. This means that if either party breaches the terms of the order, the other party can enforce it.
How long does a consent order last?
Once the court approves a consent order, then the order is valid and enforceable until and unless one of the parties later applies for the order to be set aside or removed.
