It’s important to appoint somebody who has authority to manage your affairs if you are unable to do so yourself. This can be done by way of a Lasting Power of Attorney (LPA).

This will ensure that only those who are appointed as your Attorneys can manage your affairs and not somebody you have not personally chosen.

There are two types of Lasting Power of Attorney:

  • One covers all of your legal and financial property and affairs.
  • The other covers any personal welfare issues. You can appoint a family member, a friend or simply someone you know and trust to act as your Attorney.

One of our solicitors will also act as your attorney if there is nobody suitable among your family and friends or if you think that they need professional support.

What is lasting power of attorney?

A Lasting Power of Attorney (LPA) are legal documents that allows you (the ‘Donor’) to appoint one or more people (known as ‘Attorneys’) to make decisions on your behalf in relation to your property and financial affairs and health and welfare. This gives you more control over what happens to you in the future before or after you lose mental capacity.

How much does a lasting power of attorney cost?

Both types of LPAs for a couple (two property & financial affairs, two health & welfare) will cost £995 plus VAT.

Both types of LPAs for a single person (one property & financial affairs, one health & welfare) will cost £700 plus VAT.

There is also a registration fee of £82 per document. The registration fee is payable to the Office of the Public Guardian. It may be possible to receive an exemption or reduction on this fee if the donor’s income before tax is less than £12,000 a year

What is the difference between lasting and enduring power of attorney?

A Lasting Power of Attorney is more flexible than an Enduring Power of Attorney (EPA). Whilst an LPA can be registered with immediate effect (even when you have mental capacity), an EPA can only be registered by an Attorney once a person has started to lose mental capacity. Unlike LPAs, there is only one EPA and it primarily focuses on manging a person’s financial affairs. There are two types of LPAs: property & financial affairs and health & welfare

How to activate lasting power of attorney?

Once all sections have been completed, the LPAs must be registered with the Office of the Public Guardian. It can take up to 16 weeks to register an LPA. Then, once registered with the Office of the Public Guardian, your LPAs will have a unique reference number which means they are registered and able to be used immediately.
