Reviewing Contracts

Every employee is entitled to be given a statement of terms of employment within 2 months of starting their employment.
 
If an employee is starting a new job, we recommend that they obtain legal advice in relation to the terms of that contract, particularly if they are in any doubt about the terms or if negotiations are on-going. 
 
If you are negotiating the terms of your new job, you will want to make sure that you are clear exactly what your role will entail. You may well have given up a lucrative position elsewhere in order to take the new post. The last thing you want is to find that the new job you have taken is on very different terms from what you expected.
 
Perhaps your new contract contains post-termination restrictions which aim to prevent you from working for competitors when you leave. It is important that you obtain advice on the potential enforceability of those clauses. 
 
Equally, where there is a complicated remuneration structure in your new post, clarification in the contract of employment is important so that the risk of potential disputes in the future can be reduced.
