January 'Divorce and Separation Boom'
It is a very sad but true fact that January is always the busiest month that witnesses the highest rate of legal breakups.

Often people will obtain information prior to Christmas and then will wait until after the Christmas break and the children have returned to school before consulting a Solicitor.

Statistics confirm that for the past four years married and unmarried couples separating are on the increase. Sadly, not all marriages or relationships survive.

There are many reasons why January is labelled the “divorce month”. If couples have been unhappy for a while they will often decide to give their children one last Christmas with a view to making their move in the New Year. Holiday times can be particularly stressful with feelings running high where couples are in an unhappy relationship.

The economic downturn is also an aggravating factor to relationship breakdowns.

Julie Waring, Solicitor at Morecrofts LLP commented “It is never an easy journey going through a divorce or separation even if it is the right decision. I often find that by the time a client comes to see me they have come to the resolve that they have tried everything to make the relationship work. Some have lost feelings that simply have not come back”.

There are a number of ways of divorcing/separating:-

Mediation
This is where couples will meet with a qualified Mediator (who is often a qualified Solicitor) who is there to guide and assist the parties in coming to an amicable solution in relation to divorce, finances and children.

Collaborative Law
This is where couples attend a series of meetings accompanied by their collaboratively qualified Solicitor again with a view to coming to an amicable solution.

Litigation
The more traditional route where the party will instruct a Solicitor with a view to negotiating via Solicitors or in the alternative proceeding with an application to Court.

Julie Waring comments “I have found that more clients are opting to go down the Mediation or Collaborative Law route as they find this a much more dignified and cost efficient way to deal with their separation. However, in some cases Mediation or Collaborative Law is not always appropriate and therefore the litigation route is another option”.

It is vital from the outset that you choose the best and experienced Solicitor for you. You need to see a Solicitor who makes you feel confident and at ease.
